Vibe Village Promotion Terms and Conditions

GAME OF SKILL COMPETITION (BASED ON SURVEY RESPONSES):
TERMS AND CONDITIONS
1. Information on ‘how to enter’ and prize details forms part of these conditions of entry. Entries not completed in accordance with these terms and conditions or received after the closing date will not be considered.
2. The promotion commences on 00:01 June 2, 2008 and closes at 11:59pm May 4, 2009 (“Promotion Period”). No responsibility is accepted for lost, late or misdirected entries.
3. Entry is open to residents of Australia only aged 18 years of age or over. Employees of the Promoter and their immediate families are ineligible to enter.
4. Participants can enter via the Vibe Village Website – http://www.vibevillage.com.au. Entry into the competition is free and only valid if all details provided on entry are completed. There is a limit of one entry per participant and per household residence. Subsequent entries by the same entrant will be disqualified and removed prior to each draw.
5. All entries become the property of the Promoters. The Promoter reserves the right to use the content of winning and runners-up entries (including the entrants’ names, addresses and telephone numbers) for the purpose of future promotions, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant.
6. This is a game of skill with entrants required to:
6.1. join Vibe Village by completing the general survey available at the Vibe Village Website; and
6.2. complete the Sunbeam survey which will also be made available at the Vibe Village Website, and warrant that all responses are true and correct at that time (“survey responses”).
Those survey responses will be judged by and on behalf of the Promoter. Each survey response will be awarded a score based on the response.
7. All entries are judged on an individual basis and winners will be determined by the Promoter and notified by email within twenty-one (21) days of the Promoter receiving the valid entry. The date that the email is sent to the winner will be the date of the prize (“Date of Prize”). Details of the winners will also be published at the Vibe Village Website – http://www.vibevillage.com.au.
8. The Promoter’s decision in relation to any aspect of this promotion including the selection of competition winners is final and binding on every person who enters. No correspondence will be entered into.
9. First Prize:
9.1. The best valid entries selected during the Promotion Period will win one (1) Sunbeam Nutrihair model 8600 Hairdryer valued at $99.95 (“First Prize”).
9.2. There are 1000 First Prizes to be won throughout the Promotion Period or until stock is exhausted.
9.3. All First Prizes that are won throughout the promotion will be delivered (at the Promoter’s expense) to the winner’s address as provided upon registration within twenty-one (21) days from the Date of Prize.
10. Second Prize:
10.1. This half price offer is valid for 7 days from notification by email of the 50% offer.
10.2. The second best valid entries selected during the Promotion Period will win one (1) opportunity to purchase one (1) of the following Sunbeam Nutrihair Hairdryers at a discounted price:
(a) Model 8600 for an amount of $50.00; or
(b) Model 8400 for an amount of $40.00
(“Second Prize”)
10.3. There are 4000 Second Prizes to be won throughout the Promotion Period or until stock is exhausted.
10.4. All Second Prizes that are won throughout the promotion will be delivered (at the Promoter’s expense) to the winner’s address as provided upon registration within twenty-one (21) days from the Date of Prize.
11. Remaining Prizes:
11.1. All remaining valid entrants that have not won a First Prize or a Second Prize will (subject to stock being available) win one (1) voucher to receive cashback (“the Voucher”) from the purchase of one (1) of the following Sunbeam Nutrihair Hairdryers:
(a) Model 8600; or
(b) Model 8400
(“the Hairdryers”)
11.2. The use of the Voucher is subject to the following conditions:
(a) the winner must print the Voucher from an attachment to an email which the Promoter will send to the winner;
(b) the winner must comply with any terms written on that Voucher;
(c) the winner must purchase one of the Hairdryers from any retail outlet;
(d) the Hairdryer must be purchased after the commencement of the Promotion, but before the expiration of the Voucher;
(e) the Voucher will be valid for use for thirty (30) days from the Date of Prize;
(f) the winner must send the original receipt of purchase of the Hairdryer together with the Voucher to the following address:

(g) if the Voucher is still valid upon receipt, and the receipt of purchase is compliant, the winner will receive the following cashback:
(i) $20.00 for the Model 8600; or
(ii) $15.00 for the Model 8400
12. The total prize pool is: $304,750.00.
13. All prizes include GST and prize value is based on recommended retail value as provided by the supplier and is correct at the time of printing. Any change in the value of prizes between the publishing date and the date prizes are delivered is not the responsibility of the Promoters.
14. Delivery details of all prizes will be specified by email to the competition winners and will include an expiry date for delivery. Any prizes that remain undelivered or unclaimed by the competition winner after the expiry date or within 60 days of the intended delivery date where no expiry date is specified will be forfeited by the competition winner.
15. The Promoter accepts no responsibility for loss or damage to prizes in transit. The Promoter makes no representations or warranties as to the quality/suitability of any of the goods/services offered as prizes.
16. In the event that any prize item is unavailable, the Promoter reserves the right to substitute a prize item of equal or greater value. Except with the written consent of the Promoter, prizes are not transferable or exchangeable and cannot be taken as cash. The Promoter has absolute discretion as to whether it will provide such consent and need not provide any reasons to any person for providing or withholding consent.
17. The Promoter may in its absolute discretion suspend, cancel or recommence the promotion if:
17.1. for any reason the promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the promotion; or
17.2. the determination of the prize winners or the delivery of the prizes is prevented or hindered by any outside agent or event including but not limited to vandalism, power failure, tempest, natural disaster, acts of God, civil unrest or strikes or other industrial action.
18. To the full extent permitted by law, the Promoter will not be liable in respect of any claim for any loss or damage whatsoever, (including, without limitation, any consequential, indirect, special, punitive or incidental damages by reason of any act or omission, deliberate or negligent, by the Promoter, or its agents) or for any personal injury suffered by an entrant or participant in connection with the promotion. This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws.
