NAME: Sovereign Hill GAME OF SKILL COMPETITION (BASED ON SURVEY RESPONSES):
TERMS AND CONDITIONS
1. Information on ‘how to enter’ and prize details forms part of these conditions of entry. Entries not completed in accordance with these terms and conditions or received after the closing date will not be considered.
2. The promotion commences on 00:01 November 10, 2008 and closes at 11:59pm November 30, 2009 (“Promotion Period”). No responsibility is accepted for lost, late or misdirected entries.
3. Entry is open to residents of Australia only aged 18 years of age or over. Employees of the Promoter and their immediate families are ineligible to enter.
4. Participants can enter via the Vibe Village Website – http://www.vibevillage.com.au. Entry into the competition is free and only valid if all details provided on entry are completed. There is a limit of one entry per participant and per household residence. Subsequent entries by the same entrant will be disqualified and removed prior to each Agent approval process
5. All entries become the property of the Promoters. The Promoter reserves the right to use the content of all entries (including the entrants’ names, addresses and telephone numbers) for the purpose of future promotions, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant.
6. This is a game of skill with entrants required to:
6.1. join Vibe Village by completing the general survey available at the Vibe Village Website; and
6.2. complete the Sovereign Hill survey which will also be made available at the Vibe Village Website and warrant that all responses are true and correct at that time (“survey responses”). Those survey responses will be judged by and on behalf of the Promoter. Each survey response will be awarded a score based on the response.
7. All entries are judged on an individual basis and winners will be determined by the Promoter and notified by email within twenty-one (21) days of the Promoter receiving the valid entry. The date that the email is sent to the winner will be the date of the prize (“Date of Prize”).
8. The Promoter’s decision in relation to any aspect of this promotion including the selection of winners is final and binding on every person who enters. No correspondence will be entered into.
9. Prizes:
9.1. The entries which are judged as the best during the Promotion Period will win First Prize.
9.2. The entries which are judged as being unsuccessful during the Promotion Period will receive a Complimentary Prize.
10. First Prize
10.1. Winners of the First Prize will receive one (1) Annual Family Pass to Sovereign Hill, Ballarat valued at $AU170.00 (“the Prize”).The definition of Annual Family Pass, as shown on the voucher means and includes: two (2) adults; and up to and including four (4) children aged between five (5) and fifteen (15) years inclusively.
10.2. Winners that are determined in accordance with Clause 9.1 may also receive additional discount offers throughout the Promotion Period which can be gifted to friends, family or colleagues (“Discount Offers”). Any terms and conditions relating specifically to those discount offers which are not provided for at Clause 12 will be prescribed upon delivery of each offer.
10.3. There are 550 First Prizes to be won and distributed throughout the Promotion Period.
10.4. All First Prizes that are won throughout the Promotion Period will be available for immediate download from the winner’s Viber Profile page in the form of a voucher (“the Voucher").
11. Terms of Use of First Prize. The use of the First Prize is subject to the following conditions:
11.1. the winner must print the Voucher from their Viber Profile page;
11.2. the winner must comply with any terms prescribed on that Voucher;
11.3. the winner must upon entering Sovereign Hill present (and hand over) the Voucher, along with valid photo ID, (full name, address and photo must match their licence or similar ID);
11.4. the Voucher must be printed prior to each and every visit;
11.5. the Voucher is not valid in conjunction with any other offer;
11.6. the Voucher will be valid for use for twelve (12) months from the Date of Prize, provided that all terms of this Promotion are complied with including but not limited to Clause 10.4;
11.7. failure to comply with all terms of this Promotion will result in the annual family pass being de-activated and no further Discount Offers supplied
12. Discount Offers. If any additional Discount Offers are made to winners, those Discount Offers will be available for use on the following conditions:
12.1. the winner must print the voucher for the Discount Offer from their Viber Profile Page and gift it to friends, family or colleagues;
12.2. the friend, family or colleagues must comply with any terms that are prescribed on the voucher for that Discount Offer;
12.3. the friend, family or colleagues must present and hand over the voucher for the Discount Offer, along with valid photo ID (full name and photo must match their licence or similar ID) upon entering Sovereign Hill;
12.4. the voucher is not to be distributed within the precinct of Sovereign Hill;
12.5. the voucher is not valid in conjunction with any other offer; and
12.6. the voucher for the Discount Offer will only be valid for the period of time stated on that voucher, provided that all terms of this Promotion are met including but not limited to Clause 10.4.
13. The First Prize and the Discount Offers will become invalid for use if:
13.1. any friend, family or colleagues of the Agent fail to use a Discount Offer in three (3) consecutive months;
13.2. the Promoter determines that the entrant has violated any of these terms or related “terms of service” resulting in the entrant’s membership to Vibe Village being withdrawn;
13.3. the entrant for whatever reason is removed or ends its membership with Vibe Village; or
13.4. the Promoter exercises its rights in accordance with Clause 16.
14. Complimentary Prize
14.1. Winners of the Complimentary Prize will receive a discount voucher for use at Sovereign Hill.
14.2. The discount offered by the Complimentary Prize may be subject to change throughout the Promotion Period.
14.3. Any terms and conditions relating specifically to the Complimentary Prize which are not provided for in Clause 14 or 15 will be prescribed upon delivery of the Complimentary Prize.
14.4. All Complimentary Prizes that are received throughout the Promotion Period will be available for immediate download from an email which will be forwarded to the recipient.
15. Terms of Use of Complimentary Prize. The recipient may use the Complimentary Prize on the following conditions:
15.1. the recipient must print the Complimentary Prize from an email which is received from the Promoter;
15.2. the recipient must comply with any terms prescribed on that email or Complimentary Prize;
15.3. the recipient must upon entering Sovereign Hill present (and hand over) the Complimentary Prize, along with valid photo ID, (full name, address and photo must match their licence or similar ID);
15.4. the Complimentary Prize is not valid in conjunction with any other offer;
16. All First Prizes, Discount Offers and Complimentary Prizes are restricted to use at Sovereign Hill, located in Bradshaw Street, Ballarat in the State of Victoria, Australia.
17. The total prize pool is: $93,500 (plus the value of discount offers yet to be determined);
18. All prizes include GST and prize value is based on recommended retail value as provided by the supplier and is correct at the time of printing. Any change in the value of prizes between the publishing date and the date prizes are delivered is not the responsibility of the Promoters.
19. Delivery details of all prizes will be specified by email to the competition winners and will include an expiry date for delivery. Any prizes that remain undelivered or unclaimed by the competition winner after the expiry date or within 60 days of the intended delivery date where no expiry date is specified will be forfeited by the competition winner.
20. The Promoter accepts no responsibility for loss or damage to prizes in transit. The Promoter makes no representations or warranties as to the quality/suitability of any of the goods/services offered as prizes.
21. In the event that any prize item is unavailable, the Promoter reserves the right to substitute a prize item of equal or greater value. Except with the written consent of the Promoter, prizes are not transferable or exchangeable and cannot be taken as cash. The Promoter has absolute discretion as to whether it will provide such consent and need not provide any reasons to any person for providing or withholding consent.
22. The Promoter may in its absolute discretion suspend, cancel or recommence the promotion if:
22.1. for any reason the promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the promotion; or
22.2. the determination of the prize winners or the delivery of the prizes is prevented or hindered by any outside agent or event including but not limited to vandalism, power failure, tempest, natural disaster, acts of God, civil unrest or strikes or other industrial action.
23. To the full extent permitted by law, the Promoter will not be liable in respect of any claim for any loss or damage whatsoever, (including, without limitation, any consequential, indirect, special, punitive or incidental damages by reason of any act or omission, deliberate or negligent, by the Promoter, or its agents) or for any personal injury suffered by an entrant or participant in connection with the promotion. This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws.

4. Participants must:

4.2 have been accepted into the Sovereign Hill Solid Gold Agent Program as an Agent; and are therefore eligible to receive Discount Offers in accordance with the terms and conditions for that Sovereign Hill Solid Gold Promotion www.vibevillage.com.au/sovereignhillT&C.
5. All entries become the property of the Promoters. The Promoter reserves the right to use the content of winning and runners-up entries (including the entrants’ names, addresses and telephone numbers) for the purpose of future promotions, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant.

6.1 receive and circulate a discount offer relating to entry into Sovereign Hill which will be provided to the entrant by the Promoter (“Discount Offer”); and
6.2 encourage as many family, friends and colleagues to use the Discount Offer during the Promotion Period in accordance with the terms and conditions shown and displayed on the Discount Offer.
7. Entrants will be judged by the quantity of Discount Offers that are circulated and actually used during the Promotion Period.
8. Six (6) prize winners will be selected from all correct entries received during the Promotion Period. Competition winners will be notified by email within fourteen (14) days of the promotion closing date. Details of the winners will also be published in: www.vibevillage.com.au.
