GAME OF SKILL COMPETITION: TERMS AND CONDITIONS Information on ‘how to enter’ and prize details form part of these Terms and Conditions. Entries not completed in accordance with these Terms and Conditions or received after the closing date will not be considered. Participation in this promotion is also subject to the Terms and Conditions of the Vibe Village website, available from www.vibevillage.com.au. The Promoter is PZ Cussons Australia of 282 Hammond Road Dandenong Victoria 3175. This promotion is co-ordinated by Tgarage Pty Ltd (ABN 99 118 105 025), Suite 7, Greenhill Enterprise Centre, 3 University Drive, Mount Helen, VIC, 3350 (“Vibe Village”) in their capacity as agents for the Promoter. This promotion commences at 00.01am on 24/09/2009 and final entries close at 11.59pm on 20/01/2010 (“Promotion Period”). No responsibility is accepted for lost, late or misdirected entries. Entry is open to residents of Australia aged 18 years of age or over. Employees (and their immediate families) of the Promoter, Vibe Village, their related bodies corporate and their agencies are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. Participants can enter via the Vibe Village website - www.vibevillage.com.au. Entry into the competition is free and only valid if all details provided on entry are completed and correct. There is a limit of one entry per participant. Subsequent entries by the same entrant will be disqualified and removed prior to the draw. Vibe Village reserves the right, at any time, to verify the validity and content of entries and the eligibility of entrants (including an entrant’s identity, age and place of residence), and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by Vibe Village to enforce any of its rights at any stage does not constitute a waiver of those rights. All entries become the property of Vibe Village. Vibe Village reserves the right to use the content of entries (including the entrants’ names, addresses and telephone numbers) for the purpose of future promotions, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. This is a game of skill with entrants required to: 8.1 register online at Vibe Village’s website to be a member; 8.2 follow the prompts to complete the Laundry Detergent survey questions; 8.3 submit the survey before 11.59pm on 30/11/2009; 8.4 be selected by Vibe Village to act as an Agent within the meaning of Vibe Village’s website; 8.5 have received a 500g sample pack of Radiant micro MAX laundry detergent and twelve (12) pass-on leaflets (“Leaflet”); and 8.6 post a testimonial or comments about Radiant or Radiant micro MAX to the testimonial wall located at www.washingpowdertips.com.au but during the Promotion Period; (“Agents”) or:
8.7 have received a notification about this Promotion from a friend or family member authorised by the Promoter by either an sms text message, an mms text message and image, an email with a pdf attachment or a printed Leaflet; and 8.8 post a testimonial or comments about Radiant or Radiant micro MAX to the testimonial wall located at www.washingpowdertips.com.au but during the Promotion Period, (“Guests”)
The Promoter will cover the cost of two (2) sms text messages and two (2) mms text messages and images to be sent from the Agent to family and friends for the purpose of providing them with the opportunity to enter into this Promotion as a Guest. The Agent will be responsible for the costs associated with any additional messages, emails or methods employed to make their family and friends aware of and able to enter this Promotion. 2,000 Agents and 4,000 Guests will be selected from all correct entries as prize winners. Prize winners will receive a Unique Code which will be provided by Vibe Village in their capacity as an agent and distributor for the Promoter. This Unique Code may be used to enter the “Radiant Fight Tough Stains” promotion and will be considered to have been provided directly by the Promoter for the purpose of the terms and conditions relating to the “Radiant Fight Tough Stains” promotion. Prize winners will be notified by an sms text message. Agents will be notified within 24 hours and Guests will be notified within seven (7) days of completing their entry. Vibe Village’s decision in relation to any aspect of this promotion, including the selection of prize winners and the criteria applied by Vibe Village, is final and binding on every person who enters. No correspondence will be entered into. The survey responses provided by entrants becomes the property of Vibe Village, as outlined in the Terms and Conditions of the Vibe Village website, which can be located www.vibevillage.com.au under T&Cs for “Vibe Village Content” and “Intellectual Property”. Vibe Village and/or the Promoter may, in its/their absolute discretion, modify, suspend, cancel or recommence the promotion, if: 15.1 for any reason, the promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of Vibe Village which corrupts or affects the administration, security, fairness, integrity or proper conduct of the promotion; or 15.2 the determination of the prize winners or the delivery of the prizes is prevented or hindered by any outside agent or event including but not limited to vandalism, power failure, tempest, natural disaster, acts of God, civil unrest or strikes or other industrial action. Any cost associated with accessing any promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. To the full extent permitted by law, the Promoter, Vibe Village, and their respective officers, employees and agents, will not be liable in respect of any claim for any loss or damage whatsoever, (including, without limitation, any consequential, indirect, special, punitive or incidental damages by reason of any act or omission, deliberate or negligent, by the Promoter, Vibe Village or their respective agents) or for any personal injury suffered by an entrant or participant in connection with the promotion. This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws. The personal information which you disclose to Vibe Village as part of this promotion will be collected, used, stored and disclosed by Vibe Village in accordance with its privacy policy which can be viewed at www.vibevillage.com.au.
