Kettle Chips: GAME OF SKILL COMPETITION: TERMS AND CONDITIONS
1. Information on ‘how to enter’ and prize details form part of these Terms and Conditions. Entries not completed in accordance with these Terms and Conditions or received after the closing date will not be considered. Participation in this Promotion is also subject to the Terms and Conditions of the Vibe Village website and the Code of Conduct, available from www.vibevillage.com.au.
2. The Promoters areSnack Brands Foods Pty Limited and Snack Brands Industries Pty Limited trading as Snack Brands Australia (ABN 38 424 554 643) Level 3, Building E, 24-32 Lexington Drive, Bella Vista, NSW 2153. This Promotion is co-ordinated by Tgarage Pty Ltd (ABN 99 118 105 025), Suite 7, Greenhill Enterprise Centre, 3 University Drive, Mount Helen, VIC, 3350 (“Vibe Village”).
3. This Promotion commences at 00.01am on 30/11/2009 and final entries close at 11.59pm on 7/03/2010 (“Promotion Period”). No responsibility is accepted for lost, late or misdirected entries.
4. Entry is open to residents of Australia aged 18 years of age or over. Employees (and their immediate families) of the Promoters, Vibe Village, their related bodies corporate and their agencies are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5. Participants must enter via the Vibe Village Website - www.vibevillage.com.au. Entry into the competition is free and only valid if all details provided on entry are completed and correct. There is a limit of one entry per participant. Subsequent entries by the same entrant will be disqualified and removed prior to the draw. 6. Vibe Village reserves the right, at any time, to verify the validity and content of entries and the eligibility of entrants (including an entrant’s identity, age and place of residence), and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by Vibe Village to enforce any of its rights at any stage does not constitute a waiver of those rights.
7. All entries become the property of Vibe Village. Vibe Village reserves the right to use the content of entries (including the entrants’ names, addresses and telephone numbers) for the purpose of future promotions, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant.
8. This is a game of skill with entrants required to:
8.1 register online at the Vibe Village Website to be a Vibe Village Member;
8.2 follow the prompts and complete the Kettle Chips survey questions;
8.3 submit the survey before 11.59pm on 24/01/2010;
8.4 be selected by Vibe Village to act as one (1) of 1000 Vibe Agents (as defined on the Vibe Village Website) for this Promotion (“a Vibe Agent”);
8.6 have received three (3) x 200g bags of Kettle Chips from Vibe Village together with a leaflet detailing how to enter the Kettle Chips “Win Time to Do It” promotion, which is a promotion separate to this one, run by the Promoters independently and located at www.kettletime.com.au (“the Other Kettle Chips Promotion”); 8.7 access and use the ‘Agent Dashboard Page’ provided by Vibe Village for the Vibe Agent on the Vibe Village Website for use in this Promotion;
8.8 share with friends, family and other persons, the information in connection with this Promotion, the Kettle Chips brand and the Other Kettle Chips Promotion; and
8.9 submit or upload to their ‘Agent Dashboard Page’ product reviews, photos, videos, posts and any other relevant material reliant to the Vibe Agent’s experience with the Kettle Chips and this Promotion (“the Vibe Agent’s Material”).
9. For the purpose of Clause 8.8 of these Terms and Conditions, when ‘sharing’ information about this Promotion and the Other Kettle Chips Promotion, the Vibe Agents may invite and encourage friends and/or family members to visit www.kettletime.com.auand enter the Other Kettle Chips Promotion by: 9.1. sending from their ‘Agent Dashboard Page’, a maximum of ten (10) SMS messages prepared by Vibe Village to friends and/or family members;
9.2. sending from their ‘Agent Dashboard Page’, a maximum of ten (10) MMS messages prepared by Vibe Village, to friends and/or family members with MMS compatible phones;
9.3. forwarding the SMS message prepared by Vibe Village from the Vibe Agent’s own personal mobile phone (at their own cost) to friends and/or family members;
9.4. forwarding the MMS message prepared by Vibe Village from the Vibe Agent’s own personal mobile phone (at their own cost) to friends and/or family members with MMS compatible phones; or
9.5. any other reasonable, appropriate and legal means available.
10. When sharing information in accordance with Clause 9 above, the Vibe Agent agrees and acknowledges that:
10.1. there is no limit on the number of SMS or MMS messages a Vibe Agent can send to friends and/or family members via their own mobile phone;
10.2. any costs incurred through the use of a mobile phone or device or any other means of distribution will be at the cost of the Vibe Agent and will not be paid for or reimbursed by the Promoters or Vibe Village;
10.3. costs incurred by each Vibe Agent will vary dependent on the network provider; and
10.4. information should not be forwarded to any person other than friends and/or family members with whom they have a direct relationship and who consent to receiving such information.
11. Vibe Village reserves the right to remove any Vibe Agent’s Material that is not relevant to this Promotion or the Kettle Chips brand or any Vibe Agent’s Material that is in breach of the Terms and Conditions.
12. Vibe Village will judge all entries including without limitation, the Vibe Agent’s Material submitted or uploaded on each ‘Agent Dashboard Page’ and make a determination (using its absolute discretion) as to the prize winner taking into account the following:
12.1. the quality of the Vibe Agent’s Material;
12.2. the Vibe Agent’s sharing of information in accordance with Clause 8.8 of these Terms and Conditions; and
12.3. any other factors that the Promoters or Vibe Village may consider relevant in determining the prize winner.
13. One (1) Vibe Agent will be selected from all correct entries as the prize winner.
14. The prize winner will receive $1000 AUD.
15. The Prize winner will be notified by e-mail by the 17th March,2010.
16. Vibe Village’s decision in relation to any aspect of this Promotion, including the selection of the Vibe Agents and the Prize winner and the criteria applied by Vibe Village, is final and binding on every person who enters. No correspondence will be entered into.
17. The survey responses provided by entrants become the property of Vibe Village, as outlined in the Terms and Conditions of the Vibe Village website, which are located at www.vibevillage.com.au under T&Cs for “Vibe Village Content” and “Intellectual Property”. 18. Vibe Village and/or the Promoters may, in its/their absolute discretion, modify, suspend, cancel or recommence this Promotion, if:
18.1. for any reason, this Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of Vibe Village which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion; or
18.2. the selection of the Vibe Agents or the Prize winner or the delivery of the Prize is prevented or hindered by any outside agent or event including but not limited to vandalism, power failure, tempest, natural disaster, acts of God, civil unrest or strikes or other industrial action.
- Any cost associated with accessing any promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
- To the full extent permitted by law, the Promoters, Vibe Village, and their respective officers, employees and agents, will not be liable in respect of any claim for any loss or damage whatsoever, (including, without limitation, any consequential, indirect, special, punitive or incidental damages by reason of any act or omission, deliberate or negligent, by the Promoters, Vibe Village or their respective employees or agents) or for any personal injury suffered by an entrant or participant in connection with this Promotion. This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws.
